Terms of Service

MyHeirlooms is a digital service operated by MyHeirlooms Inc. (“Company,” “we,” “us,” or “our”). The MyHeirlooms service allows individuals and families to capture, store, organize, and reflect on personal objects, stories, photos, audio recordings, and related materials (collectively, the “Service”).

By creating an account, accessing, or using the Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

You must be at least 13 years old (or the minimum age required by law in your jurisdiction) to use the Service.

You retain full ownership of all photos, audio recordings, transcripts, text, and other materials you upload or create through the Service (“Content”).

To operate the Service, you grant the Company a non-exclusive, worldwide, royalty-free, revocable license to host, store, process, reproduce, display, and transmit your Content solely for the purpose of providing, maintaining, improving, and securing the Service, including making your Content accessible to people you explicitly invite to your space.

We do not claim ownership over your Content.

The Service may allow you to invite family members or others to view or contribute to shared spaces. You are responsible for managing access permissions and understanding that Content shared with others may be viewed, downloaded, or copied by those recipients.

We are not responsible for how invited users use or share Content once access is granted.

The Service may offer optional AI-assisted features, such as transcription, summaries, titles, object identification, or organizational suggestions.

You acknowledge that AI-generated outputs may be incomplete, inaccurate, or misleading; are provided for informational and organizational purposes only; and do not provide legal, historical, medical, genealogical, or appraisal advice.

You are solely responsible for reviewing, editing, and determining the appropriateness of any AI-generated output before relying on or sharing it.

We reserve the right to remove content or restrict access if these Terms are violated.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Notify us promptly if you believe your account has been compromised.

We may offer paid plans, including recurring subscriptions and one-time purchase options. Current offerings may include a monthly plan and a one-time “lifetime” access purchase.

Prices, features, and availability may change over time. Where required by law or platform policy, changes will apply prospectively and will be disclosed in the Service or via the applicable app store purchase flow.

Purchases are processed through the applicable app marketplace (for example, Apple’s App Store). Your purchase, cancellation, renewal, refund, and billing relationship may be governed by the marketplace’s terms and policies in addition to these Terms.

Unless otherwise stated in the Service or required by law, subscription fees are non-refundable once paid. A “lifetime” purchase grants access for the life of the Service and is not a guarantee that the Service will be available indefinitely.

We may, in our discretion, provide credits, refunds, or prorations in exceptional circumstances, but we are not obligated to do so unless required by law or marketplace policy.

The Service is provided on an “as-is” and “as-available” basis. While we aim for reliability, we do not guarantee uninterrupted or error-free operation.

We may add, modify, suspend, or discontinue features at any time, including introducing paid plans or usage limits in the future.

You may stop using the Service at any time.

We may suspend or terminate access if we reasonably believe you have violated these Terms, created risk or legal exposure, or misused the Service.

Upon termination, reasonable efforts will be made to allow you to export or delete your Content, subject to legal or technical limitations.

To the maximum extent permitted by law: (a) the Service is provided without warranties of any kind, express or implied; and (b) the Company shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, loss of Content, or reliance on AI-generated outputs.

Some jurisdictions do not allow certain limitations, so these may not apply to you.

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.

The Service is operated by MyHeirlooms Inc., Washington, United States.

We may assign or transfer these Terms, in whole or in part, in connection with a merger, reorganization, sale of assets, or transfer of the Service.
